Course Outline: This course is covering the elements of contracts according to Shari’ah and what makes a contract valid or invalid Islamically. It also covers various prohibited types of sales. It further discusses the different khiyaaraat (options) in contracts, and will cover the topics of: musharakah, mudarabah, murabahah, ijarah, Salam and banking system in Islam. Then it concludes with a discussion of partnerships, the valid thereof, and the invalid, istisna.
Topics also covered: 1- the sales contract 2- constituents of sale 3- conditions of sale 4- Conditions for the executability of a sale 5- conditions for bindingness 6- agreements and differences in sale conditions 7-status of the contract 8-invalid and defective sales.
